By accessing or using SetnBit ("Service", "we", "us", "our"), you agree to be bound by these Terms of Use. If you disagree with any part of the terms, you may not access the Service. SetnBit provides an AI-powered development assistant that helps developers create, improve, and optimize code. These terms apply to all users, including developers, enterprises, and API clients.

2. Intellectual Property Rights

SetnBit and its original content, features, and functionality are owned by SetnBit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit any of the content, software, or services without prior written consent.

The AI-generated code suggestions remain your property, however SetnBit retains rights to improve its models based on anonymized usage patterns. You grant us a license to process your code solely for the purpose of providing the Service.

3. User Obligations

You agree to use SetnBit only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to violate any applicable laws or regulations.
• Attempt to reverse engineer, decompile, or extract source code from our AI models.
• Upload malicious code, viruses, or any content that could harm the Service or other users.
• Use the Service to generate spam, fraudulent content, or violate third-party rights.
• Share your access credentials or resell access to the Service without authorization.

4. AI-Generated Code Disclaimer

SetnBit uses artificial intelligence to generate code suggestions, fixes, and optimizations. While we strive for accuracy and quality, AI-generated code may contain errors, security vulnerabilities, or logical flaws. You are solely responsible for reviewing, testing, and validating any code generated by the Service before using it in production environments. SetnBit does not warrant that the generated code is error-free, secure, or suitable for your specific use case.

5. Limitation of Liability

To the maximum extent permitted by law, SetnBit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Our total liability shall not exceed the amount you paid us during the twelve months prior to the event giving rise to liability.

6. Termination

We may terminate or suspend your access immediately, without prior notice, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the courts located in Düsseldorf, Germany.
